Los retos planteados por el avance y desarrollo de las tecnologías disruptivas han dinamizado la actividad del legislador, exigiendo nuevas respuestas y garantías a bienes jurídicos ya conocidos. Este es ahora el caso de la privacidad del pensamiento y de la igualdad entre personas, que han derivado en el nacimiento de nuevos derechos como la privacidad mental o el derecho al acceso equitativo a la aumentación cognitiva. En el presente artículo se estudiarán ambos derechos, así como su encaje tanto en (...) el ordenamiento jurídico español como en el chileno. Agency is a power, but what is it a power to do? The tradition presents us with three main answers: (1) that agency is a power to affect one’s own will, consequent upon which act further events ensue, beginning with the movement of a part of one's body; (2) that agency is a power to affect one’s own body, consequent upon which act further events ensue, beginning with the movement of an object that one touches; and (3) that agency is (...) a power to affect that material upon which one brings one's action to bear---e.g. the apple one is peeling (with a knife in one's hand). These three answers correspond to three increasingly expansive conceptions of the province of human agency. I refer to them, respectively, as volitionalism, corporealism and materialism. Only the first two are seriously considered in contemporary action theory. Favoring the third, and hoping to sharpen the conflict between the third and the first, I criticize the second. Corporealism has been a popular position—arguably, the default position in the philosophy of action—since Donald Davidson’s classic paper “Agency” (1971). Although it seems to occupy a sensible middle ground between volitionalism and materialism, corporealism is, I argue, indefensible: it shares the vulnerabilities of both its two rivals, without possessing the strengths of either. Nevertheless, reflection on corporealism lights the road to materialism, which, in the end, is the only possible alternative to volitionalism. (shrink)

In contrast to the theories of relativity, quantum mechanics is not yet based on a generally accepted conceptual foundation. It is proposed here that the missing principle may be identified through the observation that all knowledge in physics has to be expressed in propositions and that therefore the most elementary system represents the truth value of one proposition, i.e., it carries just one bit of information. Therefore an elementary system can only give a definite result in one specific measurement. The (...) irreducible randomness in other measurements is then a necessary consequence. For composite systems entanglement results if all possible information is exhausted in specifying joint properties of the constituents. (shrink)

The conclusion of practical reasoning is commonly said to rest upon a diverse pair of representations—a “major” and a “minor” premise—the first of which concerns the end and the second, the means. Modern and contemporary philosophers writing on action and practical reasoning tend to portray the minor premise as a “means-end belief”—a belief about, as Michael Smith puts it, “the ways in which one thing leads to another,” or, as John McDowell puts it, “what can be relied on to bring (...) about what.” On this point there is little difference between followers of Davidson and followers of Anscombe, or between those who invoke Hume’s legacy and those who invoke Aristotle’s. But Aristotle himself held a very different position. According to him, the minor premise concerns particulars, a sphere controlled by perception. The perception of particulars—that is, of the really-existing people and things confronted in the field of action—plays no essential role in the modern account of rational agency. Because it does not, the modern account fails to explain how one could act for a reason, or how practical reasoning could deliver any conclusion. (shrink)

The “histone code” conjecture of gene regulation is our point of departure for analyzing the interplay between the (quasi)digital script in nucleic acids and proteins on the one hand and the body on the other, between the recorded and organic memory. We argue that the cell’s ability to encode its states into strings of “characters” dramatically enhances the capacity of encoding its experience (organic memory). Finally, we present our concept of interaction between the natural (bodily) world, and the transcendental realm (...) of the digital codes. (shrink)

For as long as there has been anything called “the philosophy of action,” its practitioners have accounted for action in terms of an associated kind of explanation. The alternative to this approach was noticed, but not adopted, by G. E. M. Anscombe. Anscombe observed that a series of answers to the reason-requesting question “Why?” may be read in reverse order as a series of answers to the question “How?” Unlike answers to the question “Why?”, answers to the question “How?” are (...) not explanatory of what they are about: they reveal, not reasons for doing something, but ways of doing something, and they have the form of what Aristotle called a practical syllogism. The alternative to theorizing action in terms of explanation, is, thus, to theorize it in terms calculation. In exploring this alternative, I argue for three main theses: first, that (pace Anscombe) it is not a matter of indifference whether we theorize action in terms of the question “Why?” or in terms of the question “How?”; second, that the question “Why?” is a question for an observer of action (the agent already knows the answer and can learn nothing from the inquiry), whereas the question “How?” is a question for the agent—and moreover, one that the agent must answer in order to achieve any end whatsoever—so that part of what is at stake is the standpoint from which action is to be theorized; and finally, that the standpoint of the agent, revealed by the question “How?”, is prior to that of an observer. Irad Kimhi considers the conundrum, first addressed by Parmenides, of how negative facts can be the case and be thought, to be the puzzle that philosophy has been working to solve since Plato and Aristotle and wants to do his part by criticizing Frege's dissociation of sense and force and developing a more Aristotelian account of judgment. Michael Della Rocca considers the conundrum a hopeless aporia that we must avoid by embracing Parmenides' radical monism of being and in a recent (...) article (“Parmenides' insight and the possibility of logic”) aims to show that Kimhi is confronted with exactly the kind of insoluble difficulties that he that finds in Frege. The present article agrees with Kimhi that we can think about what is not the case, although thinking reaches all the way to what IS the case. But Della Rocca is right that Kimhi cannot explain by virtue of what we are able to do this. The counter‐proposal says: (1) Thinking reaches to being in that we have learned to read things in the intersubjective spatial field of consciousness as model tokens of singular propositions about them. (2) Negation can be thought of because thinking has its very origin in absolute, non‐well‐founded negation. (shrink)

The aim of this paper is to explore how the history of images and conceptual metaphors resulting from them that we use in educational reflections are formed regardless of if they are problematized in practical life. Insight into history shows how these images are shaped not only by our own experiences and by the context of our lives, but also by the history of such images, which are unconsciously inscribed in our metaphorical speech through so called “residues of meaning”. The (...) paper clarifies this, using the examples of alimentary images, that are a transition from nutrix (wet nurse) to nutritor (teacher). The text offers selected examples of consideration of alimentary images. These are among the most primitive and therefore the deepest images of human experience. This history is an example of a cultural line that goes from ancient educational imagination to the more recent forms of such images, even if always with different accents. (shrink)

In this paper we are going to show that error coping strategies play an essential role in linguistic pragmatics. We study the effect of noisy speaker strategies within a framework of signalling games with feedback loop. We distinguish between cases in which errors occur in message selection and cases in which they occur in signal selection. The first type of errors affects the content of an utterance, and the second type its linguistic expression. The general communication model is inspired by (...) the Shannon–Weaver communication model. We test the model by a number of benchmark examples, including examples of relevance implicatures, quantity implicatures, and presupposition accommodation. (shrink)

Previous research on scalar implicature has primarily relied on meta-linguistic judgment tasks and found varying rates of such inferences depending on the nature of the task and contextual manipulations. This paper introduces a novel interactive paradigm involving both a production and a comprehension side and a precise conversational goal. The main research question is what is reliably communicated by some in this communicative setting, both when the quantifier occurs in unembedded and embedded positions. Our new paradigm involves an action-based task (...) from which participants’ interpretation of utterances can be inferred. It incorporates a game-theoretic design, thereby including a precise model to predict participants’ behaviour in the experimental context. Our study shows that embedded and unembedded implicatures are reliably communicated by some. We propose two cognitive principles that describe what can be left unsaid. In our experimental context, a production strategy based on these principles is more efficient than a strategy based on literal descriptions. (shrink)

Aristotle maintains that vicious people are blameworthy despite their moral ignorance, since becoming vicious was up to them and whatever is up to us we are able to do or not do. However, one’s upbringing shapes one’s moral character. Together, these claims invite an objection I call the horrible childhood challenge. According to this objection, vicious adults who suffered horrible childhoods through which they were taught to adopt bad ends as though they were good should not be held accountable for (...) their vice. Aristotle’s likely answer to this challenge reveals that, for Aristotle, a minimal degree of rationality is necessary for moral responsibility. I argue that, for Aristotle, a vicious agent is responsible for her vice only if 1) she is rational, which implies 2) she grasps a specific basic principle, thus consenting to become a certain kind of person through action. The thoroughly bad who satisfy both claims are moral idiots; those who do not may be blameless brutes. (shrink)

To determine what the speaker in a cooperative dialog meant with his assertion, on top of what he explicitly said, it is crucial that we assume that the assertion he gave was optimal. In determining optimal assertions we assume that dialogs are embedded in decision problems (van Rooij 2003) and use backwards induction for calculating them (Benz 2006). In this paper, we show that in terms of our framework we can account for several types of implicatures in a uniform way, (...) suggesting that there is no need for an independent linguistic theory of generalized implicatures. In the final section, we show how we can embed our theory in the framework of signaling games, and how it relates with other game theoretic analyses of implicatures. (shrink)

Meaning is a central concept of (bio)semiotics. At the same time, it is also a word of everyday language. Here, on the example of the world information, we discuss the “reduction-inflation model” of evolution of a common word into a scientific concept, to return subsequently into everyday circulation with new connotations. Such may be, in the near future, also the fate of the word meaning if, flexed through objectified semantics, will become considered an objective concept usable in semiotics. We argue (...) that reducing meaning to a technical term essentially synonymous to code and stripped of most of the original semantic field is not a necessary prerequisite for a meaningful application of the concept in semiotics and in biology. Pepper Culpepper’s seminal Quiet Politics and Business Power has revitalized the study of when business elites can shape policies away from public scrutiny. This article takes the concept of quiet politics to a new, and surprising, set of actors: trade union leaders. Focusing on the case of Denmark, it argues that quiet politics functions through political elite networks and that this way of doing politics favors a particular kind of corporatist coordination between the state, capital, and labor. Rather than showing (...) macrocorporatist coordination between the two classes and governments, it identifies representatives of business and labor that hold privileged positions in political elite networks. Representatives of segments are found in industries important for the Danish economy, specifically, the exporting manufacturing sector. Being at the core of the network requires not only a key position in the Danish economy but also an understanding that politics is often done best without politicians and voters. The analysis shows that trade union and business association representatives work closely on a wide number of issues through quiet politics, using their extensive network to broker and foster agreement between different stakeholders. The recent introduction of the concepts of tenderness, vulnerability, and parental care in the field of moral emotions has brought us closer to an understanding of the underlying mechanisms, but has not yet resulted in a systematic evolutionary and proximate analysis. Applying such an analysis, the present article proposes a hypothetical care mechanism that produces different motivational states or moral emotions (e.g., tenderness, sympathy, guilt, moral anger) in response to individuals perceived as vulnerable. The mechanism consists of a care system (...) automatically triggered by vulnerability cues, a system for defense and aggression, and a process of causally attributing changes in the vulnerable object’s well-being. The mechanism may also be useful in explaining moral responses in domains other than harm prevention. (shrink)

The neuroanatomical substrates controlling and regulating sleeping and waking, and thus consciousness, are located in the brain stem. Most crucial for bringing the brain into a state conducive for consciousness and information processing is the mesencephalic part of the brain stem. This part controls the state of waking, which is generally associated with a high degree of consciousness. Wakefulness is accompanied by a low-amplitude, high-frequency electroencephalogram, due to the fact that thalamocortical neurons fire in a state of tonic depolarization. Information (...) can easily pass the low-level threshold of these neurons, leading to a high transfer ratio. The complexity of the electroencephalogram during conscious waking is high, as expressed in a high correlation dimension. Accordingly, the level of information processing is high. Spindles, and alpha waves in humans, mark the transition from wakefulness to sleep. These phenomena are related to drowsiness, associated with a reduction in consciousness. Drowsiness occurs when cells undergo moderate hyperpolarizations. Increased inhibitions result in a reduction of afferent information, with a lowered transfer ratio. Information processing subsides, which is also expressed in a diminished correlation dimension. Consciousness is further decreased at the onset of slow wave sleep. This sleep is controlled by the medullar reticular formation and is characterized by a high-voltage, low-frequency electroencephalogram. Slow wave sleep becomes manifest when neurons undergo a further hyperpolarization. Inhibitory activities are so strong that the transfer ratio further drops, as does the correlation dimension. Thus, sensory information is largely blocked and information processing is on a low level. Finally, rapid eye movement sleep is regulated by the pontine reticular formation and is associated with a ''wake-like'' electroencephalographic pattern. Just as during wakefulness, this is the expression of a depolarization of thalamocortical neurons. The transfer ratio of rapid eye movement sleep has not yet been determined, but seems to vary. Evidence exists that this type of sleep, associated with dreaming, with some kind of perception and consciousness, is involved in processing of ''internal'' information. In line with this, rapid eye movement sleep has higher correlation dimensions than slow-wave sleep and sometimes even higher than wakefulness. It is assumed that the ''near-the-threshold'' depolarized state of neurons in the thalamus and cerebral cortex is a necessary condition for perceptual processes and consciousness, such as occurs during waking and in an altered form during rapid eye movement sleep. In this essay, I show how the French philosopher of science, Gaston Bachelard, reacted to the idea of phenomenology at different stages of his philosophical development. During the early years, Kantianism (through a Schopenhauerian reading of Kant) had the greatest influence on his understanding of phenomenology. Even if he always considered phenomenology a valuable method, Bachelard believed that the term noumenon is necessary, not for a full description of reality, but for probing possible sources of reality. For him, phenomena are (...) not only static objects or things observed in nature, but dynamic objects that can be produced or even created (hence phenomenotechnique). The noumenal realm lies beyond the structure of the phenomenal world. In his later “poetical” years, Bachelard did not make a strict distinction between noumena and phenomena, but instead situated the poetical (literary) image, a phenomenon of literary consciousness, in specific zones between subjectivity and objectivity; the term phenomenotechnique no longer plays any role in his study of imagination or daydreams. For the later Bachelard, phenomenology became the method or attitude that can best lead us into the unexplored regions of our consciousness (reverie) which remain largely forgotten by Western philosophy, or drowned out by its exclusive concern with other aspects of consciousness, such as rational thought. Empirical research on counterfactual thinking has found a closeness effect: people report higher negative affect if an actual outcome is close to a better counterfactual outcome. However, it remains unclear what actually is a ?close? miss. In three experiments that manipulate close counterfactuals, closeness effects were found only when closeness was unambiguously defined either with respect to a contrasted alternative, or with respect to a categorical boundary. In a real task people failed to report greater negative affect when encountering a (...) close numerical miss, while they predicted greater negative affect hypothetically. These results show that counterfactual closeness effects on affect depend on closeness being accessible and unambiguously defined. (shrink)

While the story of Stanislav Petrov – the Soviet Lieutenant Colonel who likely saved the world from nuclear holocaust in 1983 – is often trotted out to advocate for the view that human beings ought to be kept “in the loop” of automated weapons’ responses, I argue that the episode in fact belies this reading. By attending more closely to the features of this event – to Petrov’s professional background, to his familiarity with the warning system, and to his decisions (...) to defy his protocol – it becomes clear that Petrov was not seamlessly working “in his loop,” but reassessing it entirely. I claim that this exhibits a paradox intrinsic to all automated loops: namely, that their optimum function in fact rests on unforeseen human interventions that cannot be reliably codified ex ante, that is, that good judgment cannot simply be “programmed into” their protocols. This dependence, moreover, reveals automation’s ineluctable need for virtue ethics – not in the usual sense (whereby ethics deliberates about, say, possible damages and loss of life), but in the sense that ethical judgment, rightly understood, entails the reassessment of all of the conditions surrounding a decision, including whether a protocol should be followed at all. This paper represents a philosophical reflection on the nature and value of philosophy itself. Georges Canguilhem somewhat scandalously argued that the fundamental value of philosophy does not lie in truth. He suggests that truth is a typical value of science because truth is what science says and what is said scientifically. Why would a philosopher depreciate his own discipline? And does he really do so? Or is there a different motivation: to help philosophy to become a much more self‐confident voice? (...) And if truth is no longer a value of philosophy, what value fits it better? The article follows Canguilhem in his conception of truth, science, and philosophy. It is against the background of these considerations that the specific revised anthropology of the scientist or philosopher is formed. The main question is what this means for current philosophy and why it could be inspiring for philosophers today. (shrink)

Through critical examination of three main contemporary approaches to describing moral responsibility, this book illustrates why philosophers must take into account the relationship between retrospective moral responsibility and desert of praise or blame. The author advances the moral attitude account, whereby desert of praise and blame depends on the agent’s moral attitudes in response to moral reasons, and retrospective moral responsibility results from expressions of those attitudes in overt behavior.

The task of the work is to determine the strategy that will ensure the effectiveness of professional training of teachers for the prevention of adrenaline addiction in adolescents in the course of experimental work. In the process of studying the problem, the work of researchers in the selected scientific field is considered. As a result of the work (...) done, the strategy and plan of the teacher's professional training program were determined for the organization of effective professional training for preventive activities aimed at the adrenaline addiction of adolescents. Divination forms an unexpectedly high proportion of our total information on Sparta’s politics, internal and external. It should be studied diachronically, as well as generically. To abstract it from secular and political context would conceal both causes and effects of religious credulity. We read that Sparta’s hereditary dyarchs, the state’s chief generals, were appointed, controlled and deposed according to the interpretation of omens and oracles. Grand omens in particular were respected, such as earthquake or a succession of military failures. This (...) was in keeping with the Spartan bias in favour of events that all could perceive. Sparta’s kings made famous and apparently extravagant claims to have privileged ancient links with the gods. But by studying the political vulnerability of the kingship, we see these religious pretentions as defensive, the most effective shield for an institution under threat. (shrink)
